The famous actor Antonio Banderas has taken the decision to demolish the Gaviota, the house he had on the beachfront in the area of Los Monteros (Marbella). A property in which he has lived wonderful moments but that has also caused many legal problems to the actor from Malaga almost from the moment he acquired it.

Banderas bought this mansion, located on a plot of more than 4,000 square meters on the beachfront in the exclusive urbanization of Los Monteros, from the heirs of the famous journalist Encarna Sanchez in 1997 without knowing that it had been built with a fraudulent license and that it could be occupying public land.

In 2003, the community of owners of the Los Monteros urbanization denounced that part of the property occupied land reserved for public facilities in the maritime corridor. Subsequently, in 2007, the High Court of Justice of Andalusia (TSJA) declared the construction illegal.

For years, Banderas has been litigating to keep it standing and in 2010 signed an agreement with the Marbella Town Hall in order to regularize the situation of the property, which involved ceding more than 1,200 meters of garden land and demolishing part of the outer wall.

This cession allowed the extension of a section of the promenade of the municipality in accordance with the General Urban Development Plan (PGOU) approved by the Consistory that same year 2010.

However, after the General Urban Development Plan (PGOU) was annulled in 2015, the villa was again in an irregular situation since the Supreme Court invalidated this planning and with it the regulation of the house.

In the end, this past July, the actor decided to demolish the house and build it again. Antonio Banderas has assured journalists, during his attendance to the Starlite Gala, that “the law has nothing to do with the demolition of his house in Marbella”. The decision to demolish it derives exclusively from his desire to “make a new house”.
